Attorney Matthew Porter Appointed as Town of Watertown Judge

WATERTOWN — A town of Watertown judge accused of sexual misconduct has resigned.

In a letter to Town Supervisor Joel R. Bartlett last week, Town Justice Andrew N. Capone resigned, effective on Feb. 15. The resignation was expected.

Mr. Capone wrote that he decided to call it quits because he could not perform his duties and preside over the court since he was barred from the court.

Mr. Capone was charged Oct. 31 with official misconduct after a woman accused him of forcing her to have a sexual encounter.

Just as the news was breaking about the judge’s resignation, the Town Board on Friday afternoon named a replacement for Mr. Capone. Matthew J. Porter, a lawyer with Conboy, McKay, Bachman and Kendall, was appointed to the position. He’ll have to run for the position in November.
